By accessing or using any Russet Studio website, application, game, or service (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Services.

These Terms apply to all visitors, users, and others who access or use the Services. We reserve the right to update these Terms at any time. We will make reasonable efforts to notify you of material changes — by posting a notice on our website or sending an email to your registered address. Continued use of the Services after changes constitutes your acceptance of the revised Terms.

Some features of the Services require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Keep your account information up to date
• Maintain the confidentiality of your username and password
• Not share your account credentials with others
• Not transfer, sell, or otherwise convey your account to any third party
• Notify us immediately of any unauthorised use or breach of your account

You are solely responsible for all activity that occurs under your account, whether or not you authorised it. Russet Studio will not be liable for any loss or damage arising from unauthorised use of your account credentials.

We reserve the right to reclaim or reassign usernames that violate these Terms or impersonate another person or entity.

You agree to use the Services only for lawful purposes and in a manner that does not:

• Violate any applicable local, national, or international law or regulation
• Infringe the intellectual property rights of Russet Studio or any third party
• Transmit unsolicited or unauthorised advertising or promotional material
• Attempt to gain unauthorised access to any part of the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or disassemble any portion of the Services
• Upload or transmit viruses, malware, or other malicious code
• Collect or harvest user data without consent

We reserve the right to suspend or terminate access for any user who violates these Terms.

Russet Studio is committed to maintaining a safe, welcoming, and fair community. When using any interactive or community feature of the Services — including games, forums, chat, guilds, or social channels — you agree not to:

• Harass, bully, threaten, or intimidate other users
• Use hate speech or discriminatory language targeting race, ethnicity, gender, religion, sexual orientation, disability, or national origin
• Impersonate any person, entity, or Russet Studio staff member
• Spam, flood, or repeatedly post unwanted content
• Distribute malware, phishing links, or harmful software
• Use exploits, cheats, hacks, bots, automation scripts, or unauthorised third-party software to gain an unfair advantage in games
• Buy, sell, trade, or transfer accounts or in-game assets outside of officially sanctioned systems
• Engage in any form of account boosting or carry services prohibited by game rules
• Disrupt, grief, or intentionally degrade the experience of other players

Violations of this Code of Conduct may result in warnings, temporary suspensions, permanent bans, or legal action depending on the severity. Russet Studio has sole discretion in determining violations and appropriate consequences.

All content within the Services — including but not limited to games, software, music, artwork, video, text, logos, trademarks, game characters, world lore, and UI elements — is the exclusive property of Russet Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes. This licence does not include the right to reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, sublicense, or otherwise exploit any content without our prior written consent.

Fan art, fan fiction, and non-commercial community content created in the spirit of our games and worlds is generally welcomed. Commercial use of Russet Studio intellectual property always requires prior written authorisation.

Some Services may allow you to submit or share content such as reviews, comments, forum posts, screenshots, videos, or community creations ("User Content"). By submitting User Content, you grant Russet Studio a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, and display that content in connection with the Services and our promotional activities.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe any third-party rights. You are solely responsible for your User Content and must not submit content that is unlawful, defamatory, harassing, obscene, or that infringes any third-party rights.

We reserve the right to remove, edit, or refuse any User Content at our discretion and without prior notice. Removal of content does not constitute a waiver of any rights we may have.

The Services may include virtual items, currencies, and other digital content ("Virtual Goods"), including but not limited to: in-game cosmetics, mounts, pets, character skins, emotes, virtual currency, loot boxes, season passes, downloadable content (DLC), and Founder Packs.

You acknowledge and agree that:

• Virtual Goods are licensed to you, not sold. You do not own Virtual Goods; you receive a limited, revocable licence to use them within the Services.
• Virtual Goods have no real-world monetary value and cannot be exchanged for cash or cash equivalents unless expressly stated.
• Virtual Goods are not transferable between accounts except through officially supported systems.
• Russet Studio may modify, rebalance, remove, or discontinue Virtual Goods at any time, with or without notice, and without liability to you.
• Any Virtual Goods associated with a terminated or banned account may be forfeited.
• Russet Studio reserves the right to manage, adjust, and maintain virtual economies to ensure a balanced experience for all players.

All purchases of Virtual Goods are final. Refund eligibility is governed by our Refund Policy.

All purchases of digital products — including games, downloadable content, soundtracks, and Virtual Goods — are generally final. We will review refund requests on a case-by-case basis in accordance with applicable consumer protection law and our Refund Policy.

Physical merchandise is subject to a separate return policy available at the time of purchase. Russet Studio is not responsible for delays or losses caused by third-party shipping carriers.

Chargebacks initiated outside of our refund process may result in account suspension pending investigation.

Russet Studio may offer access to games or features that are in beta, early access, or pre-release states. By participating, you acknowledge that:

• Beta and early access content is provided "as is" and may contain bugs, errors, or incomplete features
• Content, features, gameplay mechanics, and systems may change significantly before or after launch
• Character progress, save data, and in-game items may be reset, wiped, or modified at any time
• Features shown or described during beta are not guaranteed to appear in the final release
• Participation in beta or early access does not guarantee access to the final product
• Feedback and bug reports you provide may be used by Russet Studio without compensation

Purchases made during early access are subject to our Refund Policy. We make no guarantees regarding the final state of any early access product.

Certain features of our games and Services require an internet connection and rely on online infrastructure that we operate. You acknowledge that:

• Online features may be modified, limited, or discontinued at any time
• Scheduled or unscheduled maintenance may cause temporary unavailability
• Online servers and services are not guaranteed to remain available indefinitely
• We are not liable for any loss of progress, items, or data resulting from server downtime or service discontinuation
• We will make reasonable efforts to provide advance notice before discontinuing significant online features

We reserve the right to shut down, retire, or migrate online services as needed for operational, legal, or technical reasons.

The Services may contain links to third-party websites or integrate third-party services such as payment processors, social platforms, streaming services, or analytics providers. These are provided for convenience only. Russet Studio has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party services you use in connection with ours.

Russet Studio respects the intellectual property rights of others and expects users of the Services to do the same. If you believe that material on our Services infringes your copyright, please refer to our dedicated DMCA & Copyright Policy for instructions on submitting a takedown notice.

We will respond to valid DMCA notices in accordance with applicable law. Repeat infringers may have their accounts terminated.

Russet Studio reserves the right to suspend, restrict, or permanently terminate your access to any or all of the Services at our sole discretion, with or without notice, for any reason — including but not limited to:

• Violation of these Terms or our Community Standards
• Fraudulent, abusive, or harmful conduct
• Chargebacks or disputed payments
• Legal requirements or law enforcement requests
• Extended periods of account inactivity

In severe cases — such as cheating, harassment, fraud, or abuse — termination may occur immediately and without prior warning. Upon termination, your licence to use the Services ends immediately, and you may lose access to account data, Virtual Goods, and any purchased content associated with the account.

You may close your account at any time by contacting us. Account closure does not entitle you to a refund of purchases unless required by applicable law.

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Russet Studio does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Services is entirely at your own risk. No advice or information obtained from Russet Studio or through the Services creates any warranty not expressly stated in these Terms.

To the maximum extent permitted by applicable law, Russet Studio and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, in-game progress, or Virtual Goods — arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to Russet Studio in the twelve months preceding the claim, or (b) $100 USD.

Russet Studio shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government actions, power failures, internet outages, distributed denial-of-service attacks, third-party service failures, or other events outside our reasonable control. In such circumstances, our obligations will be suspended for the duration of the event.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Russet Studio is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
